II.Rights of the data subjects

1) You have the right

  • pursuant to Article 15 GDPR you are entitled to receive information about your personal data processed by us and to the information listed in Article 15 (1) lit a)-h) GDPR.In particular, you can demand information on the data processing purposes, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data, if this has not been collected from us, and on the existence of automated decision-making process, including profiling, and, where applicable, providing meaningful information on their details (“right to information”);
  • pursuant to Article 16 GDPR to immediately require rectification of inaccurate personal data and the completion of incomplete personal data (“right to rectification”); 
  • in accordance with Article 17 GDPR to require the erasure of personal data concerning you, unless processing is necessary to exercise the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims (“right to erasure”);
  • in accordance with Article 18 GDPR to request the restriction of processing of your personal data if the correctness of the data is disputed by you, is unlawful but you oppose its erasure and we no longer need the data, but you require it for the establishment, exercise or defence of legal claims or you have objected to the processing pursuant to Article 21 GDPR (“right to restriction of processing”);
  • in accordance with Article 20 GDPR, to receive your personal data that you have sent to us in the course of consent or for the execution of the contract in a structured, commonly used and machine-readable format or to request transmission to another controller where this is technically feasible and does not affect the rights and freedoms of other persons (“right to data transmission”);
  • in accordance with Article 7 (3) GDPR to revoke the consent you have granted us at any time.In this case, we may no longer continue the data processing that is based on this consent for the future, whereby the legality of the processing carried out based on your consent until the revocation is not affected ("Right to withdraw consent");
  • pursuant to Article 22 GDPR not to be subject to a decision based solely on automated processing - including profiling - that will have legal effect or negatively impact you in a similar manner, unless the decision is necessary for the purpose of concluding or fulfilling a contract between you and us, not permitted by law or not with your express consent.

2) Right to object

If data is processed on the basis of the legitimate interests in accordance with Article 6 (1) lit f) GDPR, you also have the right to object to the processing at any time in accordance with Article 21 GDPR in so far as there are reasons arising from your particular situation or the objection is directed against direct advertising or related profiling.In the event of an objection by you, we may no longer process your personal data unless there are verifiably compelling legitimate grounds for the processing that override your interests, rights and freedoms or the processing of the assertion, exercise or defence of legal claims.This exception does not apply if your objection is directed against direct marketing or related profiling.In that case, we may in no case process your personal data for this purpose.To exercise your right of objection, you can, for example, send us a corresponding e-mail.

3) Right of appeal

In accordance with Article 77 GDPR, you have the right to lodge a complaint with a supervisory authority.In general, you can contact the supervisory authority at your usual residence or place of work or our headquarters.

III.Processing your personal data and purpose of processing

1) Your visit to our website

When you visit our website, the browser you use automatically sends information to the server of our website.This information is saved temporarily in a log file.Data collection and processing is carried out on the basis of our legitimate interest in accordance with Article 6 (1) sentence 1 lit f) GDPR for the purposes of a smooth connection to the website, convenient use of our website, evaluation of the system security and stability as well as for further administrative purposes.

It relates to the following information which is recorded without your assistance and stored until automated deletion:

  • IP address of the requesting computer,
  • The date and time of access,
  • Name and URL of the accessed file,
  • Website from which access is made (referrer URL),
  • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

2) Contract processing

a) If you buy products in this online shop, will provide us with your personal data in the ordering process, e.g. by entering your data when opening a customer account.We process your data pursuant to Article 6 (1) lit b) GDPR to fulfil and process the contract concluded with you.For this purpose, your data will be forwarded to the purchasing system (Exit B GmbH, Sickingenstrasse 70, 10553 Berlin) that we have used and for the shipment of goods to you to the transport company commissioned by us (DHL Paket GmbH, Strässchensweg 10, 53113 Bonn, DPD Deutschland GmbH, Waidandtstrasse 1, 63741 Aschaffenburg, Germany), and used for invoicing and communication with you.

b) If you have created a customer account, the data you have stored will be stored permanently until you delete your customer account or object to the processing.Otherwise we store your data in consideration of the legitimate interests for the duration that corresponds to the regular limitation period (3 years starting from the end of the year in which you made the data known to us).Your data will then be deleted unless we are obliged to retain them for longer storage due to legal requirements, e.g. to store invoices (10 years) or business letters (6 years) in accordance with Section 147 AO.In such cases, your data is blocked for use for the duration of further storage and then deleted.

3) Newsletter

You have the option of subscribing to a newsletter.By subscribing to the newsletter, you consent in accordance with Article 6 (1) lit. a) GDPR that we use your e-mail address as well as your name for sending regular advertising e-mails ("newsletter").In this case, your data (name and e-mail address) will be saved until you unsubscribe from the newsletter or otherwise revoke your consent to us.You can unsubscribe at any time, e.g. via a link at the end of each newsletter, or by sending us your unsubscribe request by e-mail.

4) Use of the contact form

You can send us a message via our contact form.By submitting your message you consent to the processing of your personal data transmitted with your message in accordance with Article 6 (1) (a) GDPR in such a way that we may use it for the purpose of answering or processing your request and for communicating with you ,The personal data collected by us for the use of the contact form will be automatically deleted after completion of the request made by you.

5) Payment processing

Depending on which payment method you choose during the order process, you may disclose your data to third parties or you may submit a credit check in accordance with Article 6 (1) a) of the GDPR.You can find the relevant information in the following points.

a) PayPal

If payment method “PayPal” is selected as part of online ordering, the payment is processed via PayPal (Europe) S.à r.l. and Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg.You must first register with your PayPal account data or open a PayPal account.When opening the account, you provide PayPal your personal data.Processing of data by PayPal takes place in accordance with Article 6 (1) lit. a) GDPR.PayPal uses your PayPal account information to identify you first and then process the payment.

b) Purchase on account (payolution)

In cooperation with payolution GmbH, Am Euro Platz 2, 1120 Vienna, Austria, we offer you the method of payment purchase on account.When you select the purchase on account payment type, we assign our payment claims against the customer to Bank Frick & CO AG. Furthermore, we will transfer the personal data you have disclosed to payolution.Using your data payolution performs a credit check at the following companies:

With your consent to the disclosure of data and credit check, you authorise us/payolution to perform data processing in accordance with Article 6 (1) a) GDPR.In the event of a negative credit assessment, we reserve the right to refuse to use the payment type “Purchase on invoice” and refer you to the other methods of payment offered.If the "Purchase on account" method of payment is accepted, you can can pay with debt-discharging effect only to the Bank Frick & CO AG account provided to you.However, we always remain your contractual partner and are responsible for handling the contract.

When you select the payment method Amazon Payments, the payment transaction is made directly through the payment service provider Amazon Payments Europe s.c.a., 5 Rue Plaetis, L-2338 Luxembourg.If “Amazon Payments” is selected as a payment method as part of the online ordering process, you first need to log in to your Amazon account data or create an Amazon account.When opening the account, you provide PayPal your personal data.The processing of data by Amazon takes place in accordance with Article 6 (1) lit. a) GDPR.Amazon Payments uses the information on your Amazon account in order to initially identify you and then process your payment.

D) Credit card (VISA/MasterCard)

In collaboration with VR Payment GmbH, Saonstrasse 3a, D-60528 Frankfurt am Main, we offer you the credit card payment method (VISA or MasterCard) .

By selecting the payment method credit card and entering your credit card details in the course of the payment process, you disclose your personal data to VR Payment.Data processing by VR Payment is thus carried out in accordance with Article 6 (1) lit. a) GDPR.VR Payment uses the information to identify you first and then process the payment.Data processing thus also takes place on the basis of Art. 6 (1) lit b) GDPR.

6) Cookies

On our website, we use cookies that improve the usability of our website and enable the use of certain features.These are small files that your browser automatically creates and that are stored on your device when you visit our site.Most of the cookies we use are for the purpose of recognizing that you have already visited individual pages on our website - so-called session cookies - and will be deleted from your hard drive after the end of the browser session.Other cookies - so-called temporary cookies - remain on your device for a certain period of time and allow us to recognise your device on your next visit.If you visit our website again, it automatically recognises that you have already been with us and what entries and settings you have made, so you do not have to enter them again.We also use cookies in order to statistically record the use of our website and to compile and evaluate user profiles using pseudonyms for the purpose of optimizing our offer, advertising and the design of our website in line with demand (see Note 7 for more for details).

7) Analysis tools

a) Google Analytics

For analysis purposes, we use the tool "Google Analytics", a web analysis service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter "Google"). The legal basis for the data processing described below is Art. 6 (1) a) DSGVO and thus your consent given via our Consent Manager, which you can revoke at any time.

Google Analytics uses "cookies" (see section III. 3). The information generated by the cookie, such as browser type/version, operating system used, the previously visited page (so-called referrer URL), IP address (host name of the accessing computer) and time of the server request are transmitted to a Google server and stored there. For maximum storage limitation, we have chosen the shortest storage period of 14 months for Google Analytics.

IP anonymisation is also activated on our website, i.e. your IP address is shortened by Google beforehand. The shortened IP address transmitted by your browser as part of Google Analytics is also not merged with other data from Google, which means that conclusions about your person are excluded.

The information collected is used to evaluate your use of our website in anonymised form, to compile anonymised statistics on website activity and to provide other services associated with website and internet use for the purposes of market research and demand-oriented design of our website.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. B) Google Adwords conversion tracking

We use “Google AdWords” and conversion tracking in this context, an analysis service from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (in what follows “Google”), to evaluate the use of our website statistically for the purposes of optimisation.Google is certified for the Privacy Shield (EU U.S. Data Protection Convention) that provides a guarantee of compliance with European data protection legislation. 

If you click on an advertisement delivered by Google, a cookie (see Note 6) is stored for conversion tracking on your device.These cookies become invalid after 30 days, do not contain any personal data and thus do not serve personal identification.If you visit certain websites of our website and the cookie has not yet expired, Google and we can recognise that you have clicked on the advertisement and have been forwarded to the relevant website.Every Google AdWords customer receives a different cookie, so no cookies can be tracked through our pages.Using the conversion cookie, we can understand the total number of users who have clicked on their ad and were redirected to a page with a conversion tracking tag.However, we do not receive information that personally identifies users.

If you do not want to participate in tracking, you can prevent the setting of cookies by setting your browser accordingly by blocking cookies from the domain "www.googleadservices.com".You will not be included in the conversion tracking statistics.

c) intelliAd

We use IntelliAd Media GmbH, Sendlinger Str. 7, 80331 Munich (“Intelliad”) for analysis purposes.In the context of balancing interests this serves to safeguard our overriding legitimate interests in optimal marketing, ongoing optimisation and the design of our offer in line with demand.The processing of your data as described below is therefore performed in accordance with Art. 6 (1) lit f) GDPR.

“Cookies” are used for the purposes of IntelliAd tracking (see Note 6).The information generated by the cookie, such as the browser type/version, the operating system used, the referrer URL, IP address and time of the server request are transferred to a IntelliAd server and stored there.However, your IP address is stored anonymously, i.e. your IP address is shortened beforehand so that the identification of your person is excluded.The information obtained is used to analyse your use of our website in anonymised form and to create usage profiles with the use of pseudonyms.

11) Social media plug-ins

We use on our website for advertising purposes, and to make the use of our website more personal for you, social media plug-ins of the social networks Facebook, Twitter, Instagram, Google+, Pinterest and the bookmarking service AddThis.The purpose of the underlying advertising is to be regarded as a legitimate interest within the meaning of Art. 6 (1) sentence 1 lit f) GDPR.

The integration of these plug-ins by us takes place using the so-called "Shariff solution", i.e. buttons are integrated, which correspond to the plug-ins, but without confirmation of the buttons no connection is established from your browser to the respective networks.Only when the button is actively pressed by you, is data processed according to the following points.

a) Facebook

On our website, we use social plugins (“plugins”) from social network Facebook, which is operated by Facebook Inc., 1601 S.
